JESSICA HOWARD - PhD Student Profile

Jessica graduated from the University of Melbourne in 2000 with a BA/LLB (Hons). After graduating, she completed her articles and was admitted to legal practice in Victoria. In 2001, she worked as associate to Justice North in the Federal Court of Australia. She is currently a Lecturer in the Melbourne University Law School.

Her research interests lie generally in the area of international law, with particular emphasis on human rights, refugee law and international criminal law. Her most recent publications include ‘Australia’ in B. Brandon and M. du Plessis (eds), The Prosecution of International Crimes:  A Practical Guide to the Prosecution of ICC Crimes in Commonwealth States, Commonwealth Secretariat:  London (2005) 127-152 (with McCormack T.L.H.), and a review of ' The Torture Papers: The Road to Abu Ghraib’ in (2005) 6(1) Melbourne Journal of International Law 189-203

Abstract of PhD Thesis
'To Deter and Deny': International Law and Australia's Interdiction of Asylum Seekers', (expected completion date: July 2006)

Jess' thesis draws on general international law and human rights jurisprudence on the extraterritoriality of obligations, including jurisprudence of the European Court of Human Rights (ECHR). Through a case study of the Australian government's 'Pacific Solution', the thesis considers the human rights obligations involved in the interdiction and interception of asylum seekers. The thesis considers a possible normative framework for lawful conduct of offshore processing and protection of refugees and asylum seekers.
