Official Launch of
the APCML
8 August 2002
Although the APCML has
been conducting activities for a number of months, the Centre was
officially launched on 8 August 2002 at HMAS Penguin in Sydney (see
adjacent picture). The Australian Minister of Defence, Senator Robert
Hill, officiated at the launch in the presence of representatives
from regional Embassies and High Commissions, International and
Non-Government Organizations including the ICRC, UNHCR and AUSAID,
regional law firms, as well as representatives from the APCML partners.
At the launch a number of cultural events featured the Asia and
Pacific Regions. Presentations were given by Senator Hill, MAJGEN
(Redt) Jioji Konrote, the Fijian High Commissioner in Australia,
the APCML Director, Prof Tim McCormack, the ICRC's Regional Delegate
for the Pacific, Mr Thomas Gurtner, and the APCML's Patron, Sir
Ninian Stephen. The event was a very significant one in the life
of the APCML and will is featured in the Photo Gallery.

Australia and Entry Into Force of the Rome Statute
1 July 2002
To mark the entry into force of the Rome Statute, the APCML co-hosted (with Australian Red Cross and the Institute of International and Comparative Law) an afternoon seminar on 1 July 2002 in the new Melbourne Law School building. The seminar was attended by more than 180 people and addressed a range of issues in relation to the establishment of the International Criminal Court.
Speakers focused on the Australian ratification and implementing legislation and upon implications of entry into force for the ADF. We also heard from a USAF JAG officer about the US position in relation to the ICC. The seminar was followed by a celebratory reception co-hosted by the Royal Dutch Embassy and Australian Red Cross.
ICRC Points of Contact Seminar, Slovakia
31 June - 3 July 2002
The ICRC regional delegation for Central and South East Europe conducted a seminar for Laws of Armed Conflict Points of Contact within the armed forces of the region. This was the third annual POC seminar conducted. The purpose of the seminar was to examine methods of developing training in Laws of Armed Conflict and to more fully integrate Laws of Armed Conflict issues into the planning for and conduct of military operations.
The APCML provided a staff member to feature at the POC seminar the approach of the Australian Defence Force to the integration of Laws of Armed Conflict and related law into operations.
Ottawa Treaty on Anti-Personnel Mines Conference, Switzerland
June 2002
The APCML Deputy Director, LTCOL Kelly travelled to Geneva in June 2002 to participate in a conference to develop a commentary for the Ottawa Treaty on Anti-Personnel Mines. Mike had been involved in this issue as an Australian delegate to the Oslo Conference which created the Treaty in 1997 and subsequently in the domestic legislation, ratification and doctrine writing process for Australia. The conference was critical to the development of interpretations of the Treaty that relate to the problematic issues of coalition operations with non-Party States and to closing loopholes concerning production and development. The principal author of the commentary is Stuart Maslin and it is expected that it will be published towards the end of 2003.
International Humanitarian Law for Filipino Professors of International Law
13-22 May 2002
Prof McCormack, Dr Helen Durham (from the Australian Red Cross) and Bruce Oswald lectured on the 'Training Course on International Humanitarian Law for University Professors' conducted between 13-17 May 2002 at the Legenda Hotel, Subic Freeport Zone, Olongapo City, Philippines. This course was a collaborative effort between the International Committee of the Red Cross, the APCML and the Institute of International Legal Studies - University of Philippines Law Centre. 28 Professors from around the Filipino archipelago studied International Humanitarian Law with a view to the introduction of International Humanitarian Law issues into Filipino Law School curricula.
'Legal' Day at the ADF Peace Keeping Centre, RA
9 May 2002
The APCML team delivered the "Legal Day" at the Australian Defence Force Peacekeeping Centre's Peace Operations Seminar at Williamtown on 9 May 2002.
The Seminar involved not only members of the ADF but NGO, civilian police, foreign affairs and international representation. The program consisted of presentations on "The Laws of Occupation and Peace Operations in Collapsed States" - LTCOL Kelly, "The Law of State Sovereignty (Territorial and Political Integrity)" - Prof McCormack, "The Impact of International Tribunals on Peace Operations" - Prof McCormack & LTCOL Kelly, "Legal Issues, National Laws, ROE and Their Application to MNF Operations" - Bruce Oswald and "International Humanitarian Law and Human Rights Law in Peace Operations (including the UN SG's Bulletin)" - LTCOL Muggleton. The day included an open forum discussion and was an excellent opportunity to exchange views with participants who had a wide range of experiences.
Australian Red Cross International Humanitarian Law Instructor's Course
15-19 April 2002
Staff from the APCML provided a number of lectures on International Humanitarian Law matters on the Australian Red Cross Instructors course held from 15-19 April 2002. Alison Duxbury spoke on 'The Changing Nature of Warfare: The 1977 Additional Protocols'; Bob Mathews spoke on 'Legal Regulation of Weapons'; Bruce Oswald spoke on 'The Geneva Conventions, PWs/Detainees and the INTERFET Experience' and 'Mercenaries'. The major goal of the course is to significantly raise levels of knowledge, understanding and appreciation of International Humanitarian Law amongst those who practice or conduct International Humanitarian Law training within the Australian Defence Force.
Pushing the Envelope: ADF Contributions to Operations and International Law' Conference
20-22 February 2002
The APCML hosted its first public conference from 20-22 February 2002 in the new Melbourne Law School building. The conference examined the recent contribution made by the ADF to the development of international and operations law in areas such as the use of force, peacekeeping in East Timor, the law of the sea, responses of States to the 'war against terrorism' and the proposed International Criminal Court.
Keynote speakers at the conference included The Rt Hon Sir Ninian Stephen, Major General Roger Powell, Mr W Hays Parks and Professor Peter Rowe. The conference brought together military personnel, military and civilian legal practitioners, representatives from Australia and foreign governments, non-government organisations and academic institutions.

Australian Federal Police Peace Operations Training Programs
Associate Director Bruce Oswald has lectured twice in 2002 on 'Aspects
of the law of United Nations peace operations' during the intensive
'CIVPOL Peace Operations Pre-deployment Training Program Pre-deployment
Training Program conducted by the Australian Federal Police (AFP).
The AFP conducts these courses to prepare Australian State, Territory
and Federal police for deployment on peace operations. Bruce will
again lecture on this course in September 2002.
